Right of Withdrawal and Product Returns
1. If the Buyer is a consumer within the meaning of the Consumer Rights Protection Law (a natural person purchasing a product for purposes not related to their economic or professional activity), the Buyer (consumer) can exercise the right of withdrawal without providing any justification. In accordance with the conditions of the Cabinet of Ministers Regulation No. 255 "Regulations on Distance Contracts" of the Republic of Latvia, the Buyer has the right to withdraw from the purchase agreement within 14 calendar days from the moment of product delivery by submitting a withdrawal request to ELYNDI.
2. To exercise the right of withdrawal, the Buyer should review the instructions available here and request a product return or exchange.
2.1. The costs of returning or exchanging products are covered by the customer - the amount is 3.10 EUR.
If the customer returns a product from abroad, all costs related to customs clearance (including customs duties, fees, VAT, and other possible payments) are fully covered by the customer.
The Seller is not responsible for additional costs incurred due to customs procedures and reserves the right to refuse to accept the returned shipment if customs payments are not covered.
2.2. The return locker fee is deducted from the total refundable amount. Therefore, when receiving the refunded money, you will receive 3.10 EUR less than the original purchase price of the product.
3. Upon receiving the withdrawal request, the Seller immediately notifies the Buyer of its receipt by sending an electronic notification to the email address provided by the Buyer.
4. The Buyer is considered to have complied with the withdrawal period (14 days) if the Buyer's withdrawal request is sent to the Seller before the end of the withdrawal period. In case of a dispute, the Buyer is obliged to documentarily prove the withdrawal period.
5. After sending the withdrawal request, the User delivers the product back to Elyndi at the address: Ulbrokas iela 34C, Rīga, LV-1021, in the original packaging with the invoice, without undue delay, but no later than 14 days. This period is considered observed if the User delivers the products back before the end of the 14-day period.
6. ELYNDI commits to reviewing the returned product within 14 working days after receiving it. After inspecting the product, according to the Buyer's choice and the conditions of the right of withdrawal, a product exchange, refund, or gift card issuance will be carried out.
7. If the Buyer exercises the right of withdrawal in a timely manner, this Agreement is terminated, and the Seller refunds the payments received from the Buyer to the account specified in the withdrawal request or using the same payment method used by the Buyer for the initial transaction, if the Buyer has not specified an account number in the withdrawal request.
8. If the Buyer clearly expressed a desire to receive the product using a delivery method other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to refund the Buyer's additional delivery expenses.
9. The direct costs of returning the product are covered by the Buyer. If the product cannot be returned by mail or locker due to its characteristics, the Buyer covers all costs associated with returning the product.
10. The Buyer can exercise the right of withdrawal under the following conditions:
10.1. the returned product(s) must be in the original packaging;
10.2. the product must not be damaged;
10.3. the product must not be used, the shipping box must be intact, and the product must not have lost its commercial appearance (labels attached to the clothing, protective films, etc.) (this does not apply to products already damaged during delivery, for which the Buyer has indicated objections upon receipt confirmation);
10.4. the product to be returned must be in the same condition as it was at the time of receipt.
10.5. if a gift was included with the shipment - when returning the product, the gift must also be returned without signs of use.
11. The Seller has the right to refuse to accept the product back if the deadlines for returning the product were not observed.
12. The Buyer is responsible for maintaining the quality and safety of the product during the withdrawal period. The Buyer is responsible for any decrease in the value of the product if it has been used in a manner incompatible with the principle of good faith, including for purposes other than determining the product's characteristics or functionality. Products must be undamaged, retain their appearance (labels not removed or damaged, protective films not torn, etc.), and unused. The product must be returned in its original packaging, in the same configuration as it was received, definitely returning the purchase document, delivery document, and other product accessories that were attached to it at the time of receipt. If the product is not fully assembled, is damaged, untidy, or not properly packaged, Elyndi has the right to refuse the product and not refund the money paid by the Buyer for the product.
